This series of private client seminars provides a thorough understanding of core private client practice, concentrating on Wills, Trusts, Probate and Lasting Powers of Attorneys.

Legal training with a twist: In addition to learning or brushing up on legal skills, throughout the series, we will be looking at how to make private client practice profitable by giving high value advice. We deal with how to uplift your earnings from wills by offering inheritance tax advice.

With clients increasingly shopping around for probate quotes, we show you how to make sure you don’t price yourself out of the probate market and still be profitable.

When it comes to Lasting Powers of Attorney, many solicitors are turning away clients because of the myths that have grown around the making of Lasting Powers, like “They’re too time-consuming” or “Clients won’t pay for the time”. We will tell you why it makes good business sense to do them and how to make Lasting Powers of Attorneys a profitable addition to your practice and get the business your competitors are missing out on.

Remi Aiyela The speaker: Remi Aiyela

Remi Aiyela is a solicitor, barrister, accredited mediator and former council member of the Society of Trust and Estate Practitioners (STEP) and is a past chairman of the Surrey branch.

She is the founder of Cavendish Law a niche private client law firm based in Belgravia, London. She advises high net worth individuals, both domiciled and non-domiciled, and businesses on all aspects of succession and estate planning, including wills, trusts, estate and trust administration and mental capacity. She was formerly Head of Private Client for the Guildford office of a leading commercial firm.

Remi speaks and writes regularly on private client topics, having lectured for CLT, Lexis Nexis, Altior and other training providers. She has released a DVD Guide to Making a Will which is currently available for sale at Hammicks in Fleet Street, London. Remi has also recently set up an internet video website called JustLaw TV and she is looking for contributors who wish to speak on various areas of legal practice.

1. Will Drafting
The Will Drafting seminar is for those with only very little or no experience of drafting wills. The course will take participants through simple will drafting to more complicated scenarios and solutions for clients. The seminar will include:

• Testamentary capacity
• Taking instructions for wills
• Appointing guardians and executors
• Dealing with different types of assets
• Dealing with business owners
• Ensuring tax efficiency and high value advice
• Using trusts • Dealing with the family home
• Common problems in will drafting

2. Probate Practice
The Probate Practice seminar will give practitioners good working knowledge of the process for dealing with the administration of estates and will include the procedures for:

• Taking instructions
• Ascertaining the assets of the estate
• Completing the inheritance tax accounts
• Preparing the papers for the grant
• Collecting in the assets
• Settling liabilities
• Paying legacies and dealing with beneficiaries
• Finalising the administration
• Pricing for probate

3. Understanding Lasting Powers of Attorneys and Living Wills:
A comprehensive one-day course that looks at making Lasting Powers of Attorneys and Living Wills under the Mental Capacity Act and the Lasting Power of Attorney (Prescribed Form) Regulations 2009 and we will cover:

• The scope of each type of Lasting Power of Attorney
• Formalities and taking instructions for a Lasting Power of Attorney
• Establishing lack of capacity under the Mental Capacity Act 2009
• Completing the forms
• Acting as Certificate Provider
• The procedure for notification and raising objections
• What you should do about Enduring Powers of Attorneys
• Living Wills
